In Texas, Insurance ALE/Loss of Use Funds Are Not Required to Be Advanced to the Insured

Texas homeowner's insurance policies often provide an insured with payments for loss of use expenses. These are funds that allow an insured to purchase certain covered items and pay for certain covered expenses that are needed because the residence is partially or completely uninhabitable as a result of a covered peril. This article addresses whether an insured is legally entitled to have these loss of use funds paid as an advancement. One Texas court of appeals has weighed in on this question.
